The book is a comprehensive introduction to the work of the Estonian-German biologist Jakob von Uexküll. After a first introductory chapter by Morten Tønnessen and a second chapter on Uexküll's life and philosophical background, it contains four chapters devoted to the analysis of his main works; they are followed by a vast eighth chapter which deals with the influence Uexküll had on other philosophers and scientists, and by a conclusions focused on the possibility of updating Uexküll's work. The monograph (...) combines a careful reconstruction of the historical context in which the Uexküllian concepts emerged (the debate between mechanism and vitalism, contemporary scientific studies) and a thorough analysis of the philosophical contents of the Uexküllian views. As far as the key issue is concerned, Uexküll's notion of Umwelt refers to the perceptive and operative world which surrounds animal species; it is a subjective species-specific construction which provides living organisms with great security and behaviour stability. Moreover, the relationship that the animal carries out with its environment proves to be a complex system of semiotic interactions: its behaviour is not a set of mechanical reactions, but the result of a spontaneous attribution of meaning to the outside world, whose environmental elements are actively interpreted by the subject. The environment of animal species becomes a field of meaning, an exceedingly complex subjective elaboration; this can lessen the distance between animals and men, crediting both with the cognitive ability to grasp meanings and to use signs. Most proponents of restorative justice admit to the need to find a well defined place for the use of traditional trial and punishment alongside restorative justice processes. Concrete answers have, however, been wanting more often than not. John Braithwaite is arguably the one who has come the closest, and here I systematically reconstruct and critically discuss the rules or principles suggested by him for referring cases back and forth between restorative justice and traditional trial and punishment. I show that we (...) should be sceptical about at least some of the answers provided by Braithwaite, and, thus, that the necessary use of traditional punishment continues to pose a serious challenge to restorative justice, even at its current theoretical best. Over the last decade, theorists have persistently criticised the assumption that the International Criminal Court (ICC) can produce a noteworthy deterrent effect. Consequently, consensus has emerged that we should probably look for different ways to justify the ICC or else abandon the prestigious project entirely. In this paper, I argue that these claims are ill founded and rest primarily on misunderstandings as to the idea of deterrence through punishment. They tend to overstate both the epistemic certainty as to and the (...) size of the deterrent effect necessary in order to thus justify punishment. I argue that we should in general expect reasonably humane punitive institutions to lead to better consequences than if we abolish punishment entirely, and I show that, contrary to widespread assumption among critics of the ICC, we should not expect the conditions characteristically surrounding mass atrocity to undermine this presumption. Properly understood, the ICC equals adding another “slice of cheese” to our comprehensive crime preventive system modelled along the lines of James Reason’s Swiss cheese model of accident causation and risk management. Undoubtedly, some future perpetrators will elope through the holes in this layer too, but others will be deterred. (shrink)

A Study of Ecclesiastical Conservativism and AnxietyA German translated form of the “IPAT Anxiety Scale Questionnaire” by Cattell & Scheier and a specially developed ecclesiastical conservativism questionary were given to a sample of 330 adult, catholic, urban Ss. Several item analyses and reliability computations showed the usefulness of the scales. Analyses of correlations and variances yielded the following main results: There are statistical significant functional interrelations between ecclesiastical conservativism and the variables age, educational level, professional type, and church attendance. The (...) same holds for anxiety level and the variables professional type and church attendance. Ecclesiastical conservativism and anxiety level indices have been found to be negatively interrelated. Especially this last result is being discussed on the backgrounds of submission to authorities, individual freedom, responsibility, and anxiety. (shrink)

Lean is a new open source theorem prover being developed at Microsoft Research and Carnegie Mellon University, with a small trusted kernel based on dependent type theory. It aims to bridge the gap between interactive and automated theorem proving, by situating automated tools and methods in a framework that supports user interaction and the construction of fully specified axiomatic proofs. Lean is an ongoing and long-term effort, but it already provides many useful components, integrated development environments, and a rich API (...) which can be used to embed it into other systems. It is currently being used to formalize category theory, homotopy type theory, and abstract algebra. We describe the project goals, system architecture, and main features, and we discuss applications and continuing work. (shrink)

Der vorliegende Band bietet einen Durchgang durch Hölderlins dichterisches Schaffen und interpretiert zahlreiche Gedichte ausgehend von der Frage, wie sich das Verhältnis von Gott/Mensch/Sprache darin jeweils darstellt. Dieses zeigt sich als ein zunehmend gebrochen-fragiles; in dieser Schwächung kann sich jedoch eine neue Aufmerksamkeit für das Göttliche, das Menschliche und die Sprache entwickeln – in theologischer Diktion: Offenbarung Gottes nicht in einem „Mehr“, sondern in der Zurücknahme einer für den Menschen nicht fassbaren Fülle und im Abschied von fixierten Bildern.

English summary: This book concerns a metaphysical definition of artifacts, taken as a key term of the philosophy of technology. Due to the fact that classical determinations are not only insufficient at explicating the term but also inapplicable to real artifacts, the work tries to develop a concept of artifacts using the thought of truth given by Martin Heidegger. In so far as a hermeneutic interpretation of his oeuvre shows us, truth actually is an object-generating happening. That is why an (...) analysis of forms of judgments allows the description of factic things. Assuming that there are theoretical judgments concerning technique - wherefore technique is an historically contingent kind of metaphysics - artifacts are given as geometrical universals, meaning terms, without being able to subsume thought-independent of individuals, unless artifacts exceptionally are known as subjects of practical philosophy. German description: Diese Studie befasst sich mit der metaphysischen Bestimmung des Gegenstandes Artefakt, der fur die Technikphilosophie zentral ist. Da klassische Bestimmungen weder eine zureichende Explikation des Begriffes noch die eindeutige Identifikation solcher Sachen erlauben, greift der Autor dazu auf das Denken der Wahrheit bei Martin Heidegger zuruck. Eine hermeneutische Deutung von dessen Werk zeigt, dass Wahrheit als ein Geschehen zu betrachten ist, das Gegenstande generiert. Demzufolge ermoglicht die Analyse von Urteilsformen, faktisch begegnende Sachen zu bestimmen. The problems involved in understanding the Aristotelian notion of an ἀρχή arise from the widely accepted view that Aristotle’s theory of knowledge is torn between irreconcilable empiricist and rationalist tendencies. I argue that several puzzling features of the Aristotelian ἀρχή are clarified when it is understood as akin to the Urphänomen, which plays a central role in the scientific thought of Johann Wolfgang von Goethe. More broadly, I argue that the apparent conflict in Aristotle’s theory of knowledge is resolved by (...) seeing that Aristotle is neither an empiricist, nor a rationalist, but a “rational empiricist” akin to Goethe. In den letzten 25 Jahren hat das chinesische Recht eine beeindruckende Entwicklung erfahren. In zunehmendem Maße wird es Gegenstand wissenschaftlicher Untersuchungen, und in Deutschland erscheinen in immer größerer Zahl Publikationen, die das chinesische Recht für die Rechtsvergleichung erschließen oder es rechtsvergleichend mit anderen Rechtsordnungen erörtern. In der neuen Schriftenreihe Schriften zum chinesischen Recht, die im Auftrag der Deutsch-Chinesischen Juristenvereinigung von Professor Dr. Uwe Blaurock, Freiburg, Professor Dr. Ulrich Manthe, Passau, Dr. Knut B. Pißler, Hamburg, und Professorin Dr. Christiane Wendehorst, Göttingen, (...) herausgegeben wird, sollen in erster Linie Monographien, wie etwa herausragende Dissertationen oder Habilitationsschriften erscheinen, darüber hinaus aber auch Tagungsbände sowie kommentierte Übersetzungen wichtiger chinesischer Gesetze oder zweisprachige Gesetzessammlungen. Es soll hiermit der wissenschaftliche Gedankenaustausch mit China gefördert und für rechtsvergleichend arbeitende Juristen eine Publikationsplattform geschaffen werden.
